Folks the Realtor has no Real Liability, they can always commit silent Fraud and Say they did not know. Even if your buyers agent finds out and helps you prove the Sellers Agent Knew, there is NOTHING you can do. Even if an old MLS sheet Discloses the Known Issue, yet your were not tol - this proving the listing agent, the listing office knew at one point - still there is nothing you can do.
Now you may Choose to Sue and this will put you in court for years, the Realtors E and O insurance will STOMP you - I have seen this even in the cases with one hundred percent, without a doubt proof on the Realtor who FAILED to Disclose.
the Realtor Broke the State Law, Violated Your Rights and in order to get your money back you have to Fight, so you have to spend more money fighting, and years and time out of your life even in the situations with the - Without a Doubt Proof in Your Hand.
this is NOT how the Real Estate Industry should work, and the Voice of Real Estate - NAR shoud make sure that this does not happen - instead NAR - the Self Touting of a Higher Standard, Voice of Real Estate - they Lobby for what is best for them like banks out of real estate, buyers incentives, easy lending, mandatory E and O insurance and other "ISSUES" that are good for NAR and bad for you.
The Real Estate Industry needs a total makeover from Top to Bottom, all parts of the Real Estate Industry are out to Create a Living from you Buying and Selling Real Estate and along the way offering you NO Protection with you Loans, with Lies about problems with the House, with lies of Boundaries or Lake Frontage.
In situations like the above YOU should be able to prove they lied and that should be that, you should not have to fight and be put through local courts where it is about Opinion and Not Law and the New Comber, usually YOU the buyers well the local courts don't owe you nothing and you don' the connections that the Franchise big shot Realtors Do.
State and Federal Laws Should Protect you and be easily enforced but they are NOT. It does not matter what the MLS sheet says, the contract or the ads if it Turns out NOT to be Fact and you end up buying Something VERY different from what you thought you were buying, well you have to Fight.
The Real Estate Industry SHOULD NOT work this Way. and NAR should Make Sure of it or Drop the Voice of Real Estate Sham.

This comment is not about Livibility of a Home, it's about our crooked Realtors in this area. I dealt with one about 8 yrs ago,that demanded how my house looked,(shades certain level,Baby playpen not in the house Etc) until I got fed up and fired him (yes,you can do that),I have a friend that he took to the tune of $30,000 when he bought his home(he just passed away with no $$ back) This realator has more listings in this area then most others. I'm shopping for a house,but I will not look at one or buy anything he's connected with, people have to be aware in this area of what's going on'
